THE BOB HAWKE LABOR GOVERNMENT INTRODUCED THE AUSTRALIA ACT BY STEALTH

Evidence, that the Australia act was un-constitutionally and illegally Legislated by the Bob Hawke Labor Government in 1986 is that the Howard Coalition spent more than $100 million of taxpayers money which could have been spent on Health, roads, Water Infrastructure and Education to hold a referendum to whether the voters of Australia wanted a Republic or preferred to retain a Constitutional Monarchy.  Ten million voters plus registered and elected to retain our status quo.

Added evidence that the Australia Act was unconstitutional and illegal occurred in the High Court of Justice Chancery Division London, Case No. CH/2004/APP/0447. The Hon. Mr. Justice Lightman, said “As soon as Australia became independent, the 1900 Act ceased to have any effect as an exercise of sovereign power of the United Kingdom.”

In conclusion I believe it is not legally possible for the Parliament to change clause 2 of the Constitution and also remove sovereignty from the people and give it to the “Queen of Australia.”

It would seem the only valid source of authority for Governors and Governors General would be from the sovereign people of Australia.

In other words the only legal avenue for the Australian Government to alter the Constitution is by referendum.
